Today’s Lawful2Shoot? Focus: Are Multiple Threatening Persons a Deadly Force Threat? If a group, meaning more than one or two, individuals approach you directly and one or more of them communicate either physically and or verbally that they are intending to use physical force against you, the self-defense element of Proportionality comes into play due to the disparity of force. The disparity in numbers of attackers and size of persons, and their collective physical ability elevates violence and force to a deadly level.
Therefore, the evidence from the scene must provide definitive proof that a coordinated violent group, i.e. gang, presented more than just non-deadly force, but instead deadly force. Your reasoning must be objective—a viewpoint as other’s would view the situation--and not just your own subjective reasoning. It is an objective belief any reasonable person would agree with that the “gangs” very nature, its internal structure is based upon the ability to inflict violent force and will almost certainly cause great bodily harm because the is the sole criteria for membership.
Each gang member considers themselves a ‘violence specialist’ and adds an essential element or dimension to the group’s overall identity. Each gang is known and respected for their brand of extreme violence. Studies of gang culture and events reveal that the main objective is to cause serious bodily injury at the least and can easily cause death with no remorse.
A gang can form in a mere moment and join in a person-on-person confrontation, even before violence breaks out. Then one person becomes the victim of a ‘multiple attacker’ gang event.
When human beings engage in ‘gang activity’ it is to achieve a greater ability to produce deadly force. “Extreme Violence” is the banner under which they unite and act.” Their very presence means a deadly force threat is present. And when they focus on someone, that individual is under a deadly force threat.
Gangs can occur spontaneously, in a moment of excitement, and take on the characteristics of a pack of angry wolves which pick up a scent of an intruder or simply an outsider. And anywhere they reside no matter how briefly, if only for one minute, during that brief period they are a deadly threat because that is the tie that binds them—a cause they deem worth becoming violent for.
